Life LessonThis was sent to me via email and in it is an important life lesson that I felt needed to be shared.? Always appreciate those around you and remember how much you love people no matter how busy you are.? Take the time to tell them.? Life is short and needs to be treasured.

One day a teacher asked her students to list the names of the other students in the room on two sheets of paper, leaving a space between each name.? Then she told them to think of the nicest thing they could say about each of their classmates and write it down.? It took the remainder of the class period to finish their assignment, and as the students left the room, each one handed in the papers.

That Saturday, the teacher wrote down the name of each student on a separate sheet of paper, and listed what everyone else had said about that individual.? On Monday she gave each student his or her list. Before long, the entire class was smiling. ?Really?? she heard whispered. ?I never knew that I meant anything to anyone!? and, ?I didn?t know others liked me so much,? were most of the comments.

No one ever mentioned those papers in class again. She never knew if they discussed them after class or with their parents, but it didn?t matter. The exercise had accomplished its purpose. The students were happy with themselves and one another. That group of students moved on.

Several years later, one of the students was killed in Vietnam and his teacher attended the funeral of that special student. She had never seen a serviceman in a military coffin before. He looked so handsome, so mature.? The church was packed with his friends. One by one those who loved him took a last walk by the coffin. The teacher was the last one to bless the coffin.? As she stood there, one of the soldiers who acted as pallbearer came up to her. ?Were you Mark?s math teacher?? he asked. She nodded: ?yes.? Then he said: ?Mark talked about you a lot.?

After the funeral, most of Mark?s former classmates went together to a luncheon. Mark?s mother and father were there, obviously waiting to speak with his teacher.? ?We want to show you something,? his father said, taking a wallet out of his pocket ?They found this on Mark when he was killed. We thought you might recognize it.?? Opening the billfold, he carefully removed two worn pieces of notebook paper that had obviously been taped, folded and refolded many times. The teacher knew without looking that the papers were the ones on which she had listed all the good things each of Mark?s classmates had said about him.

?Thank you so much for doing that,? Mark?s mother said. ?As you can see, Mark treasured it.?? All of Mark?s former classmates started to gather around. Charlie smiled rather sheepishly and said, ?I still have my list. It?s in the top drawer of my desk at home.?? Chuck?s wife said, ?Chuck asked me to put his in our wedding album.?? ?I have mine too,? Marilyn said. ?It?s in my diary?? Then Vicki, another classmate, reached into her pocketbook, took out her wallet and showed her worn and frazzled list to the group. ?I carry this with me at all times,? Vicki said and without batting an eyelash, she continued: ?I think we all saved our lists?

That?s when the teacher finally sat down and cried. She cried for Mark and for all his friends who would never see him again.

The density of people in society is so thick that we forget that life will end one day. And we don?t know when that one day will be.? So please, tell the people you love and care for, that they are special and important. Tell them, before it is too late.

Remember, you reap what you sow. What you put into the lives of others comes back into your own.

SEC concedes challenges in credit-rating probes (Reuters)

WASHINGTON/NEW YORK (Reuters) ? The Securities and Exchange Commission faces hurdles proving wrongdoing at credit-rating agencies, the agency's enforcement chief said, pointing to the complexity of the cases and the industry's strong legal defenses.

SEC Enforcement Director Robert Khuzami's comments to Reuters came a day after McGraw-Hill Cos Inc disclosed on Monday that the agency may sue its Standard & Poor's unit for breaking securities laws.

Khuzami declined to comment specifically on S&P, but his remarks show how a case against S&P or other credit raters would be far from easy to win.

"There are some statutory challenges in the law, and some disclosure-related challenges that are unique to credit-rating agencies that can make the cases more challenging," Khuzami said.

"But, we don't let that stop us from investigating possible misconduct," Khuzami added. "We are looking hard at them."

The SEC's investigation into S&P may lead to the first charges against a major credit-rating company for its grading of complex structured products during the financial crisis.

Khuzami's descriptions of the challenges he faces come as financial and legal experts puzzle over why the SEC has taken a step against only S&P when Moody's Investors Service and Fimalac SA's Fitch Ratings also gave the same bonds their highest grades just months before they were marked down to junk.

"I just don't get why S&P is being singled out here," said Janet Tavakoli, a structured finance consultant. "I don't see much difference between the ratings from the three agencies."

Khuzami said there can be many reasons why law enforcers go after one firm and not another.

Without commenting specifically on the S&P matter, he said that "different actors might analyze a product in different ways, or one may know things that another does not."

It can also just be a simple issue of timing, he said, noting that cases against "similarly-situated parties" do not always move at the same pace.

"It is the painstaking job to build cases involving complex transactions or products," he said. "You look at individual emails, individual pieces of testimony, and piece together a circumstantial case, arguing that the most reasonable inference from the evidence is that the defendant knew X and said Y, and did it with wrongful intent."

In fact, some legal experts believe that the SEC may be singling out S&P over other raters specifically because of an email trail that it left behind in the crisis, even though other ratings firms may have behaved similarly.

Some emails, which were unearthed by U.S. Senate investigators, reveal that analysts at S&P had doubts about the agency's ratings for bonds issued by a collateralized debt obligation known as Delphinus CDO 2007-1. That CDO is now at the center of the SEC probe of S&P.

Some of the contents of the CDO, a portfolio of mortgage securities that were bundled into bonds, were swapped at the eleventh hour, meaning that analysts weren't ultimately rating the bonds they thought they were.

"You can take a look and see if it is different from the closing date portfolio you received from the banker," S&P's Lois Cheng wrote to colleague Lauren Sprinkle in the first of a series of exchanges made public at an April 23, 2010, hearing by an investigative panel headed by U.S. Senator Carl Levin.

In the eighth email in the set, Sprinkle copied in more senior members of the team and said it appeared that about 25 assets in the portfolio "were dummies" which had been replaced at the last minute with assets that would have "made the portfolio worse... and they would have not been able to close."

The emails were dated August 20, 2007 - just 18 days after S&P had published its ratings on the deal. After that, S&P did not downgrade any of its Delphinus ratings for four months, according to an exhibit at Levin's hearing.

A McGraw-Hill spokeswoman declined to comment.

Levin's committee introduced no Moody's emails mentioning the Delphinus CDO, except for one from an investment banker to Moody's requesting that the agency assign a more experienced analyst to his next deal. Fitch Ratings was not examined by the committee.

Levin's panel ultimately issued a scathing report in April this year that condemned S&P and Moody's for helping trigger the financial crisis. The report was referred for review to the SEC and Department of Justice.

LEGAL SHIELDS

For the past several years, the SEC has faced pressure to find a way to bring charges against the credit-rating agencies for their role in the crisis.

The task has proved exceedingly difficult.

For example, Khuzami said, certain kinds of conduct by the raters could only be addressed starting in September 2007. That was the effective date of a 2006 law that formally granted the SEC full-scale regulatory authority over raters.

In addition, the 2006 law expressly prohibits the SEC from regulating the substance of ratings. Some have asserted that this provision helped shield credit-rating agencies from enforcement actions involving how ratings are determined.

It was not until last year when the Dodd-Frank law was enacted that Congress strengthened the SEC's authority by clarifying that raters cannot assert that excuse as a defense in civil fraud actions, Khuzami said.

Even with the Dodd-Frank changes, however, credit raters have long maintained that that their ratings constitute opinions which are protected as free speech under the First Amendment to the U.S. Constitution. That defense has historically shielded the agencies from lawsuits by investors who challenged their ratings, saying they lost money by relying on them.

Although Moody's and Fitch have yet to indicate they may face any charges in connection with the financial crisis, experts say it is possible SEC enforcers could still go after them.

"It may be a case where they are staging their approach and they intend to go after the other two as well," said Daniel Drosman, a law partner at Robbins Geller Rudman & Dowd, which is suing S&P and Moody's to recover money investors lost buying top-rated bonds.

For his part, Khuzami said the SEC will continue to vigorously pursue any wrongdoing among credit rating agencies. He also said the SEC is moving forward on cases related to other financial firms who played a role in the recent credit crisis.

"It is clear that credit crisis cases remain a priority," he said. "There are others that will be coming."

Thousands entering Calif. schools without vaccines (AP)

SACRAMENTO, Calif. ? Last year's class of California kindergartners had a record high percentage of parents who used a personal belief exemption to avoid immunization requirements, a development that concerns state health officials.

More than 11,000 kindergartners missed at least one vaccine in 2010 because their parents decided to forgo inoculation. At nearly 2.5 percent of the state's 470,000 kindergartners, that's California's highest rate of declined vaccines since at least 1978, the year before the measles, mumps and rubella vaccine was required.

The percentage is more than double that in certain parts of the state, particularly in more affluent coastal communities in Northern California.

The public debate over childhood vaccinations has been growing throughout California, where last year a deadly spike in whooping cough cases killed 10 babies and sickened more than 9,100 people. The outbreak prompted a state law that requires middle and high school students to get whooping cough booster shots before going back to school this year.

The percentage of parents who sign vaccine exemptions based on personal beliefs has been rising steadily since 2004. The increase coincides with rising use of the Internet for information, said John Talarico, chief of the immunization branch for the California Department of Public Health.

"We really think a lot of it is due to honest, valid concern that parents do the best thing for their child coupled with misinformation that gets out through various forms of communication," he said.

He said state health officials want to study the personal-belief exemptions to better understand trends and behaviors. For now, he is hoping the trend will begin to slow, especially with media coverage of last year's whooping cough deaths.

Just last week, state health officials said the number of reported measles cases in California had reached a 10-year high of 28. Of those, 22 people were either unvaccinated or their vaccination status was unknown.

"When people can see disease around them, it generally drives them to think about the benefit the vaccine can give their children versus whatever else they hear," he said.

Vaccine statistics for this year's kindergartners will not be available until 2012.

Parents can file two types of vaccine exemptions ? a medical exemption or a personal belief exemption. The medical exemption is rarer and typically is reserved for children who cannot be vaccinated because of auto-immune disorders or allergies. It requires a doctor's signature.

For a personal belief exemption, parents are not required to supply any information to explain their decision.

Doctors and medical experts say vaccines are a reliable means of preventing illness with little risk of injury, but some parents don't buy into the safety of immunizations. They cite concerns about vaccines making their children susceptible to autism or diabetes.

In a comprehensive safety review of vaccines issued last month, the Institute of Medicine found there is no link between vaccines and autism or diabetes. The institute, part of the National Academy of Sciences, found that serious side effects of vaccines are rare and can include fever-caused seizures and occasional brain inflammation.

The increasing number of kindergartners entering school without immunizations poses a risk to others, especially children who have legitimate medical exemptions that prevent them from getting their shots, said Linda Davis-Alldritt, a school nurse consultant at the California Department of Education.

"Disease prevention is really a very important thing," she said. "These are diseases that can be very serious, and it can cause death and it can cause long lasting illnesses."

Parents receive information from schools and the Department of Education about the importance of inoculation and the dangers of unvaccinated children spreading infectious diseases to the rest of the community.

Overall immunity of a population to illness typically is achieved when 90 percent of the population is properly immunized. But Talarico, California's top immunization officer, said that can be misleading because unvaccinated children tend to cluster in pockets where like-minded parents decide to forgo immunizations.

"When we see these clusters, that represents the possibility of transmission of disease more quickly and in a more sustained fashion," he said.

A cluster of unimmunized children in San Diego led to an outbreak of measles in 2008 that infected 12 children. Nine of them had not been inoculated because of their parents' objections, while three others were too young to be immunized.

In some schools, as many as 30 percent of kindergartners are vulnerable to at least one vaccine-preventable communicable disease, according to data from the state Department of Public Health. The majority of schools have 100 percent immunization rates.

Certain areas of California have higher exemption rates than others. In Marin, Sonoma and Santa Cruz counties, more than 6 percent of incoming kindergartners in 2010 had parents file a personal belief exemption. By comparison, Los Angeles, San Francisco and Fresno counties had rates below 2 percent.

Barbara Lowe Fisher, co-founder and president of the National Vaccine Information Center in Vienna, Va., said parents sometimes decide to file the personal belief exemption form because they cannot find a doctor who will sign a medical exemption form.

"We've had families whose children have had reactions to vaccines, and some of them have become injured or even died. They want to make an independent, informed decision for their other children, and they can't find doctors who will write medical exemptions," she said.

She said the mission of her nonprofit is to prevent vaccine-related injuries or death through public education. It does not take a position on whether parents should have their children vaccinated, but it does defend a parent's right to opt out of a vaccine.

Some parents base their decision on what they hear from others or see on the Internet, rather than in consultation with a medical expert, said Catherine Flores Martin, director at the California Immunization Coalition, a Sacramento nonprofit that receives some of its funding from vaccine manufacturers.

"Parents have access to so much information on the Internet and I think a parent, even when they're really well educated, will have a hard time sifting through the credible resources versus the anecdotal stories," she said. "You can find whatever you want on the Internet to support your belief."

These types of comments can have a very negative effect and make that child withdraw into their shell. This may to some people seem very obvious to say, however you would not believe the amount of people who have told me this is what they were told as an infant.

I went to see many speech therapists who offered me advice which basically consisted of slowing down my rate of speech and to take a deep breath before I spoke. This did not really work for me and I have to admit my attitude was not what it should have been as I believed that it was impossible for the therapist to understand what I was going through as they had never had a stutter.

It took me nearly a year to beat the stutter and as a career I now help other people to achieve fluency.

Ignore 'obsessive' media campaign, Knox jurors told

Prosecutors demanded on Friday that an Italian court throw out an appeal by American student Amanda Knox of her conviction for murdering her roommate in a drug-fueled sex game.

Speaking for two hours in a packed room, prosecutor Giancarlo Costagliola urged the jury to keep in mind the family of the victim, British student Meredith Kercher, who was Knox's roommate at the time. His fellow prosecutor, Giuliano Mignini, urged the jurors to ignore the "obsessive" media hype and what he said was a pro-defendant slant.

A verdict in the appeals trial of Knox and her co-defendant and one-time boyfriend Raffaele Sollecito is expected at the end of September or early next month.

'Political circus'
Costagliola denounced what he said was "an obsessive media campaign that makes everyone feel like the parents of Amanda Knox and Raffaele Sollecito."

"As you make your decision, I wish that you jurors feel a little bit like the parents of Meredith Kercher, a serious, studious girl whose life was taken by these two kids from good families."

Mignini claimed that the prosecution was "subjected to systematic denigration of a political ... nature" and urged the jury to forget the pressure of an international press he said was overwhelmingly in favor of the defendants.

"The trial must be held here, in this courtroom," Mignini said. "This lobbying, this mediatic and political circus, this heavy interference, forget all of it!"

Mignini showed graphic photos from the murder, and said he will never forget seeing Kercher's eyes wide open as he went to inspect the crime scene. As if to emphasize the contrast, he also showed the court a photo of the two defendants kissing in the immediate aftermath of the killing outside the house that was being inspected by police. The move led Knox's lawyer to object.

Knox and Sollecito were convicted of sexually assaulting and murdering Kercher on the night of Nov. 1, 2007 in the house Knox and Kercher shared while exchange students in Perugia.

Knox was sentenced to 26 years in prison; Sollecito to 25. Both deny wrongdoing and have appealed the verdict, which was issued by a lower court in December 2009.

The prosecutors argue that the 21-year-old Kercher was the victim of a drug-fueled sex assault. In the original trial, the prosecutors had sought life sentences ? Italy's stiffest punishment. Like the defendant, they have also appealed the lower court's verdict, as they can in Italy.

Costagliola, at the start of closing arguments expected to last two days and involve two more prosecutors, summed up what he said were the clues that point to the defendants: bloody footprints found in the house that are compatible with those of the defendants, cell phone activity and witness testimony that appear to contradict the defendant's alibi that they spent the night at Sollecito's house and stayed there until about 10 a.m. the day after the murder, a staged burglary at the house of the murder aimed at sidetracking the investigation.

This all pointed to ascertaining the defendants' presence at the scene of the crime, he said, adding: "All clues converge toward the only possible result of finding the defendants guilty."

Knox, 24, appeared tense during the session. Her mother, Edda Mellas, said it was hard for her "as she has to listen to people saying horrible and untrue things about her."

Doubts about DNA evidence

Costagliola also talked of an independent review of DNA evidence that cast doubt on much of the genetic evidence used to convict Knox will help his daughter overturn the conviction. He challenged the results of the independent review and defended the findings of the original investigation.

Knox's hopes of being set free were a strong boost by an independent report earlier this year that cast major doubt on DNA evidence used to convict her, and also cited bungling by police scientists.

But prosecutors urged the jury to look past the confusion in the case, maintaining that Kercher's blood was on a knife handled by Knox that was identified as the murder weapon and that Sollecito's DNA was found on Kercher's bra clasp.

Both pieces of police evidence were rejected by the independent forensic experts.

Curt Knox, the defendant's father, said he was hopeful and grateful to the appellate court for having granted the review.

"We were not surprised with the results because this is what our defense experts were telling us all along," Curt Knox told The Associated Press in Perugia on the eve of the closing arguments. "I'm very thankful that the appeals court had the courage to authorize that independent review."

However, in court, Costagliola argued that the original finding could stand and said the review amounted to "a scientific falsification of the truth." Even when accepting some of the criticism in the review, he said, the jury should at least consider the traces of DNA evidence as strong clues incriminating the defendants, if not full-fledged evidence.

In an unusual move, Perugia Chief Prosecutor Giovanni Galati made an appearance at the beginning of Friday's session to express his support for the job done by prosecutors and investigators in the case, which had come under fire in the national and international media especially after the DNA review.

Next week, a lawyer representing the Kercher family and then the defense lawyers will make their closing arguments. Knox herself is expected to address the court in a final appeal to proclaim her innocence.

Worldwide attention
With young and photogenic defendants and tales of sex and drugs, the case has captivated audiences worldwide, drawing international media to Perugia since the beginning. On Friday, as the appeals trial draws to a close, the underground courtroom was packed with cameras, reporters and scores of curious residents.

Knox's story has been made into a movie for U.S. television starring Hayden Panettiere, though lawyers for both Knox and the victim's family have tried to stop it.

If acquitted, both Knox and her ex-boyfriend would be freed immediately, said Carlo Fiorio, a professor of criminal procedure at the University of Perugia. They could also have their sentences confirmed, shortened or lengthened, he said.

A third person, Rudy Hermann Guede of the Ivory Coast, also has been convicted of Kercher's murder in a separate proceeding. Italy's highest criminal court has upheld Guede's conviction and his 16-year-prison sentence. Guede denies wrongdoing.

Nobody can deny the impact of music to people?s personality. Nowadays, even kids as young as eight or nine are becoming interested in Indie fashion. The fad is all about freedom of expression, without conforming to what the stereotypes believe in. They are not the shallow because they do not dress just to impress others.

So, what does it take to be an Indie? Indie kids value their identity and liberty. They do not follow trends of the common public. They love to listen to Indie and alternative music. When it comes to their attire, most Indie kids are into hot pants with vintage tees. Girls on the other hand are attached to heavy makeup and accessories. Although many parents are against this because they can appear cheap. Their philosophy is that they look out of the ordinary when they are wearing heavy makeup and big accessories. Sometimes their hair has life on its own. They don?t care to brush. They don?t even care if they are called names by people around them.

If you know an Indie kid somewhere, do not judge. Who knows? That kid is still a son or a daughter, a brother or a sister and someone who still belongs to the human race. Nobody can really tell what the child may turn out in the future. So don?t call them misfits or outcasts because they fit perfectly in this world and they are entitled to have their own views and ideals. They just don?t want to be conformed in this world and be called as average because they are not. Rather, love them and care them, although they are unique, they are still humans.
