Longtime Madoff employee admits decades of fraud

NEW YORK (Reuters) - One of Bernard Madoff's longest-serving employees pleaded guilty on Thursday to falsifying records, a conspiracy that a prosecutor said began in the 1970s at the start of the multibillion-dollar Ponzi scheme.

Irwin Lipkin, 74, a former controller of Bernard L. Madoff Investment Securities LLC, told a Manhattan federal court judge that for years he fudged the books on Madoff's orders, but that at no point did he suspect the epic, decades-long fraud.

"While working for Bernie Madoff, I made accounting entries in financial records that I knew were inaccurate," Lipkin said. "At no time before I retired was I ever aware that Mr Madoff or anyone else at the company was engaged in the Ponzi scheme reported in the media."

Lipkin, who signed a plea agreement with federal prosecutors, pleaded guilty to charges of conspiracy to commit securities fraud and falsifying documents. The charges carry up to 10 years in prison.

Lipkin's son, Eric Lipkin, another former Madoff employee, pleaded guilty in 2011 to criminal charges of bank fraud and charges that he reported people were Madoff employees so they could receive retirement benefits.

Irwin Lipkin joined Madoff's firm in 1964, he told the court on Thursday. He was Madoff's first employee who was not a Madoff family member. Although he retired in 1998, he and his wife illegally remained on the Madoff payroll and received benefits but did not work, Lipkin said.

Prosecutor Julian Moore told judge Laura Taylor Swain that "as early as the mid 1970s" Lipkin had begun changing the financial records of accounts at Madoff's direction.

Madoff, 74, was charged in December 2008 with a decades-long fraud that the government originally estimated at as much as $64.5 billion. He pleaded guilty in March 2009 and is serving a 150-year prison sentence.

The trustee leading the search for money to return to Madoff's victims says Madoff defrauded customers of about $20 billion. The trustee, Irving Picard, so far has won over $9 billion in recoveries and settlement agreements.

On June 29, Madoff's brother Peter pleaded guilty to criminal charges. He had been chief compliance officer at his brother's firm. He has agreed to accept a 10-year prison term and will be sentenced in December.

Of more than a dozen people charged in the case, apart from Bernard Madoff, five have pleaded not guilty and are awaiting trial.

Among those five, Irwin Lipkin on Thursday said former investment advisory employee Annette Bongiorno had helped him falsify trading records. A lawyer for Bongiorno did not comment on Lipkin's accusations, but said "it saddens us that the government has insisted on prosecuting an elderly, very sick man, who ought to be left alone to die in his bed."

The case is U.S. v. O'Hara et al, U.S. District Court, Southern District of New York, No. 10-cr-228.

LOS ANGELES ? The California man behind an anti-Muslim film that led to violence in many parts of the Middle East was sentenced Wednesday to a year in federal prison for probation violations in an unrelated matter, then issued a provocative statement through his attorney.

The sentence was the result of a plea bargain between lawyers for Mark Bassely Youssef and federal prosecutors. Youssef admitted in open court that he had used several false names in violation of his probation order and obtained a driver's license under a false name. He was on probation for a bank fraud case.

Shortly after Youssef left the courtroom, his lawyer, Steven Seiden, came to the front steps of the courthouse and told reporters his client wanted to send a message.

"The one thing he wanted me to tell all of you is President Obama may have gotten Osama bin Laden, but he didn't kill the ideology," Seiden said.

Asked what that meant, Seiden said, "I didn't ask him, and I don't know."

U.S. District Court Judge Christina Snyder accepted the plea agreement and immediately sentenced Youssef after he admitted to four of the eight alleged violations, including obtaining a fraudulent California driver's license. Prosecutors agreed to drop the other four allegations under the plea deal, which also included more probation time.

All parties agreed that none of the violations had to do with the content of "Innocence of Muslims," a film that depicts Mohammad as a religious fraud, pedophile and womanizer.

However, Assistant U.S. Attorney Robert Dugdale argued Youssef's lies about his identity have caused harm to others, including the film's cast and crew. Deadly violence related to the film broke out Sept. 11 and spread to many parts of the Middle East.

"They had no idea he was a recently released felon," Dugdale said Wednesday. "Had they known that, they might have had second thoughts" about being part of the film.

He said they have had death threats and feel their careers have been ruined.

Seiden said his client admits to being the film's scriptwriter but had no other involvement except what he described as being a "cultural adviser."

Youssef, 55, was arrested in late September, just weeks after he went into hiding when the deadly violence erupted.

Enraged Muslims had demanded severe punishment for Youssef, with a Pakistani cabinet minister even offering $100,000 to anyone who kills him.

Federal authorities initially sought a two-year sentence for Youssef but settled on a one-year term after negotiating the plea deal with Youssef's attorneys. Prosecutors said they wouldn't pursue new charges against Youssef_ namely making false statements ? and would drop the remaining probation-violation allegations leveled against him. But Youssef was placed on four years' probation and must be truthful about his identity and his future finances.

Seiden asked that his client be placed under home confinement, but Snyder denied that request. Youssef will spend his time behind bars at a Southern California prison.

Youssef served most of his 21-month prison sentence for using more than a dozen aliases and opening about 60 bank accounts to conduct a check fraud scheme, prosecutors said.

After he was released from prison, Youssef was barred from using computers or the Internet for five years without approval from his probation officer.

Federal authorities have said they believe Youssef is responsible for the film, but they haven't said whether he was the person who posted it online. He also wasn't supposed to use any name other than his true legal name without the prior written approval of his probation officer.

At least three names have been associated with Youssef since the film trailer surfaced ? Sam Bacile, Nakoula Basseley Nakoula and Youssef. Bacile was the name attached to the YouTube account that posted the video.

"This is a defendant who has engaged in a long pattern of deception," Dugdale said. "His dishonesty goes back years."

Court documents show Youssef legally changed his name from Nakoula in 2002, though when he was tried, he identified himself as Nakoula. He wanted the name change because he believed Nakoula sounded like a girl's name, according to court documents.

How makers of phones and tablets are faring

Makers of phones and tablet computers have begun releasing results for the latest quarter. Many companies including Nokia and Research in Motion have been struggling to compete with Apple and manufacturers of devices running Google's Android software. Here's a look at how makers of phones and tablet computers are doing.

? Oct. 18: Google Inc. says its Motorola Mobility device-making business suffered an operating loss of $527 million, more than tripling from the same time last year, when it was still an independent company. Google is planning job cuts at Motorola, but says it still could take a few years for Google to turn that business around.

Nokia Corp. reports that its third-quarter net loss widened further to ?969 million ($1.27 billion) with a 19 percent plunge in revenue, as it struggles against the dominance of Samsung and the iPhone in the tough smartphone market. Nokia gave a grim outlook for the rest of the year as it prepares for this fall's launch of Microsoft Corp.'s new phone software, Windows Phone 8. The Finnish firm acknowledges it expects no quick gains from the new Windows launch.

? Oct. 23: Apple Inc. unveils a faster, full-sized iPad and a smaller one called the iPad Mini. The smaller one will start at $329, much more than its competitors. Both new iPads will be available starting Nov. 2.

? Oct. 25: Apple Inc. warns that profits will be down in the holiday quarter compared with a year ago because it's releasing so many new products. When a production line is new, it costs more to run and the components are more expensive.

Amazon.com Inc. says its $199 Kindle Fire HD tablet is its best-selling product worldwide, but as usual, it did not give specific sales figures.

? Oct. 26: Strong sales of Galaxy phones propelled Samsung Electronics Co.'s quarterly profit to a record high, but there's concern growth will slow in an increasingly crowded smartphone market.

HTC Corp. reports a 79 percent drop in third-quarter profit, its fourth consecutive fall in quarterly profit. It predicts revenue will drop in the holiday quarter as well despite traditional pre-Christmas buying and its introduction of two new models running Windows.

? Nov. 1: Sony Corp. says sales improved in its mobile phone segment, but sales faltered in its digital cameras because of the popularity of smartphones, which typically come with cameras.

? Nov. 2: IDC says Google's Android software for mobile devices was running on 75 percent of smartphones shipped in the third quarter, as the search company extended its lead over Apple.

? Monday: IDC says Apple's share of the market for tablet computers fell to 50 percent in the third quarter as the iPad faced more competition from Android devices such as Samsung's Galaxy tablets and Google's Nexus 7. Apple still had a solid lead and shipped more iPads worldwide than a year earlier.

Apple says it sold 3 million iPads of all kinds in the first three days the iPad Mini was available, double the 1.5 million iPads sold in the first three days after Apple launched the third-generation iPad in March and cut the price of the iPad 2.

IHS iSuppli releases analysis showing that Microsoft and Apple are garnering the highest-profit margins for their tablets, followed by Google and then Amazon.

Virtual reality could help people lose weight, fight prejudice

ScienceDaily (Nov. 6, 2012) ? Internet-based interactive games and social media outlets have become intertwined with the physical realities of millions of people around the world. When an individual strongly identifies with the cyber representation of themselves, known as an avatar, the electronic doppelganger can influence that person's health and appearance, according to a University of Missouri researcher's study. Harnessing the power of the virtual world could lead to new forms of obesity treatment and help break down racial and sexual prejudices.

"The creation of an avatar allows an individual to try on a new appearance and persona, with little risk or effort," said Elizabeth Behm-Morawitz, assistant professor of communication in MU's College of Arts and Science. "That alter-ego can then have a positive influence on a person's life. For example, people seeking to lose weight could create fitter avatars to help visualize themselves as slimmer and healthier."

In Behm-Morawitz's study, 279 users of a virtual reality community, Second Life, answered a questionnaire about their engagement with their avatar and relationships they developed online, as well as their offline health, appearance and emotional well-being. Self-presence, or the degree to which users experienced their avatars as an extension of themselves, was found to predict the influence of the avatar on people's physical reality. A strong sense of self-presence in the social virtual world positively promoted health and well-being of study participants. People with high degrees of self-presence in the cyber world reported that their experience with their avatar improved how they felt about themselves offline. Self-presence also correlated to greater satisfaction with online relationships.

"This study found no evidence of negative effects of a high degree of self-presence in the virtual world on study participants; however, that doesn't rule out the possibility," said Behm-Morowitz. "Users should practice moderation. Virtual entertainment, like other forms of diversion such as books or television, can be used in unhealthy ways."

Further research by Behm-Morawitz on virtual worlds will look at how avatars may be used to encourage tolerance of diversity. A person's race, gender or ethnicity can be altered in the virtual reality world and they can be put into simulated situations where they suffer prejudice and discrimination. Avatars can create the modern version of the book Black Like Me, in which the Caucasian author darkened his skin to experience life as an African-American in the Deep South of the 1950s.

"I am also interested in studying how using an avatar with a different race or ethnicity may increase empathy and decrease prejudice," said Behm-Morawitz. "This may occur through the process of identification with an avatar that is different from oneself, or through a virtual simulation that allows individuals to experience discrimination as a member of a non-dominant group might experience it."

The study, "Mirrored selves: The influence of self-presence in a virtual world on health, appearance and well-being," was published in the journal Computers in Human Behavior.
