Alabama worker bit by snake, denied workers' compensation ...

Obviously, in order for an injured worker in Alabama to collect workers' compensation benefits, the worker needed to be injured through the course of their employment. However, sometimes the distinction of what is and is not deemed "the course of employment" can be blurred.

For example, an Alabama log truck driver was being transported back to his personal vehicle at a service station by a labor truck at the end of his shift. En route, the occupants of the labor truck spotted a diamond back rattle snake. One worker attempted to capture the deadly snake, but was bit on each hand in the process. Consequently, the worker was hospitalized for 40 days and had to undergo physical therapy. During this time he was unable to work.

The worker filed for workers' compensation benefits, but the company denied his benefits on the grounds that this accident and subsequent injury did not result from the course of the driver's employment. The Alabama Court of Civil Appeals recently ruled that the driver in fact was not entitled to the benefits.

The court found that although the man was being transported through the course of his work, he chose to exit the truck and engage in an activity that was not expected through the course of his employment, therefore he was taking a personal risk for any resulting injury. Unfortunately for this worker, this means that his company will not cover his medical bills or missed wages.

It is not unusual for a company to dispute a workers' right to benefits in accidents where it remains unclear if the injury occurred through the course of employment. For this reason, it is often crucial for injured Alabama workers to consult with experienced legal counsel to ensure they receive their due workers' compensation benefits.

More gloomy news from Kodak: the company just announced that it will stop selling consumer inkjet printers in 2013 and instead focus its efforts on commercial printing products. This decision hardly comes as a surprise: Kodak filed for Chapter 11 bankruptcy earlier this year and attempted to auction off a stockpile of patents valued at up to $2.6 billion. The company stated on Friday that it expects to take a $90 million hit due to its floundering inkjet business. Kodak's garage sale attracted interest from unlikely alliances in the form of Apple and Microsoft versus Google and Samsung, but reportedly only reeled in disappointing offers under the $500 million mark. Hoping to rebound next year as a "lean," mean, successful machine, we'll just have to wait and see what develops for this fallen photography frontrunner.

Wallace works collected online

The great naturalist Alfred Russel Wallace now has an online presence to match that of Charles Darwin.

The two men independently formulated the theory of evolution by natural selection, and announced it in tandem in July 1858

But it is one of those quirks of history that Darwin got all the fame.

His collected works were digitised and posted on the web in 2006. Now, the writings and drawings of Wallace have received the same treatment.

The effort has been completed by the same historian, too - John van Wyhe.

But whereas Dr van Wyhe produced Darwin Online from Cambridge University, UK, he has led the new Wallace Online project from the National University of Singapore (NUS).

Wallace was a major scientific figure in South East Asia.

"What this should hopefully do is result in a major upgrade in the quality of writing about Wallace," the historian told BBC News.

"Next year is the centenary of his death. Just like 2009 was the big Darwin year, 2013 will be the big Wallace year. And I hope now that people have access to all of his literature, it will make a big difference to what they say and write about him."

Wallace Online gathers together in one place for the first time all of the naturalist's writings and illustrations.

There are 28,000 pages of searchable documents and 22,000 images. Among the online gems is that first announcement of the theory of evolution delivered to a London scientific meeting 154 years ago.

It remains one of the great coincidences in scientific history that the one person Wallace should choose to approach to share his ideas on natural selection was the only other scientist who separately had come to the same conclusions - Charles Darwin.

Quite why Wallace never achieved a similar level of fame has long been debated, but the lower profile should not be seen as a reflection on the man's talents or achievements, argues Dr van Wyhe.

The Wallace Online collection certainly bears testament to a prolific output. Like Darwin, Wallace was also a great traveller, spending large chunks of time in Brazil (1848-1853) and in South East Asia (1854-1862).

"It's very appropriate that we've done Wallace Online from NUS because Wallace was the pioneering figure in the study of this part of the world," said Dr van Wyhe.

"He spent eight years here, using Singapore as his base. He made major discoveries - he discovered hundreds of new species, going to places no naturalist had ever gone to before. And then, of course, there is The Wallace Line."

The Wallace Line is a term still in use today and refers to the sharp division between the types of animals in Australia and those on the Asian archipelago.

Wallace identified this abrupt transition, but could not satisfactorily explain it. Nor would he have been able to.

It is only with the 20th Century theory of plate tectonics that scientists can now describe how Australia, with its unique flora and fauna, was delivered from another part of the globe and abutted to South East Asia.

Dr van Wyhe said: "Wallace is an amazing example of somebody who had no privilege, no wealth, no connections - and who went out on his own to make his own way in the world; and he discovered so many amazing things, not just evolution.

"That's why for so many people, he remains such an inspiring figure.

"He's the sort of person that you can aspire to be. You can just do it yourself through independent thinking and hard work."

Yakima County assessments mirror flat real estate market

YAKIMA, Wash. ? Property value assessment cards mailed to Yakima County?s 102,000 property owners late last week generally reflect a flat real estate market for 2011, according to county Assessor Dave Cook.

Property owners who saw their year-over-year values stay the same or decline shouldn?t expect a drop in their property taxes, however, especially if they live in a city or town.

Cook said the new taxable values are for Jan. 1 of this year and do not take into account a gradual increase in home sale activity and average prices that have occurred since then.

"What is encouraging is we are seeing an appreciation of value," the longtime assessor said. "Maybe we have reached a tipping point and values will start going up again."

Sales data gathered by Headwaters-The Source of Selah show for the first eight months of this year the number of home sales increased by 161 over the same period a year ago ? an increase of 14.5 percent, to a total of 1,267. The average selling price increased by $9,500, or about 6 percent, to $169,256.

For all of 2011, the number of residential sales fell and the average sales price was $160,250, a 2.6 percent drop from 2010.

Doug Rich, broker and owner of Prestige Realty of Yakima and a board member of the Multiple Listing Service, described the housing market as a mixed bag with sales increasing in some months and declining in others.

"If I was going to characterize the market, it is real flat but showing some signs of improvement," he said.

One trend the MLS is seeing is an increase in the number of sales that require third-party approval or are a short sale, meaning the seller is offering the property for less than is owed on the loan used to purchase the property.

"It might be Yakima?s time to work those things through the process the rest of the country was seeing six quarters ago," Rich added.

Cook said the total taxable value of land in the county on which property taxes will be collected next year increased slightly more than 1 percent for 2012. Total taxable values are $13.5 billion, compared to $13.3 billion last year. The $167 million increase in taxable values includes $133 million in new construction that came on the tax rolls for this year.

The amount of new construction last year, although higher than 2010, continues to lag behind prior years. New construction in 2007 exceeded $300 million.

Cook said the one area where values increased was in farmland.

"We don?t know if it is consolidation as farmers buy land to expand their operations," he said.

What impact the assessed values have on property taxes collected next year won?t be known until taxing districts submit their operating budgets to Cook by November. It is then that Cook will calculate property tax rates that must be charged to collect those revenues for cities, the county, fire districts and other taxing districts.

A property tax increase is likely for those who live in cities because Yakima County commissioners will shift at least $2.8 million from the county road levy to the county general fund levy next year to pay debt costs on jail construction and remodeling.

City residents pay only the general fund levy, which this year amounted to $1.53 per $1,000 of assessed value. By collecting more money for the general fund levy from a relatively flat value base, property taxes will increase.

County residents will benefit from the shift because the road levy will decline, which will more than offset the increase in the general fund levy.

Cannabinoid May Treat Brain Cancer | Cancer Kick

Newswise ? Researchers at University of California, San Diego Moores Cancer Center are evaluating the safety and tolerability of a synthetic cannabinoid called dexanabinol (ETS2101). Delivered as a weekly intravenous infusion, the drug is being tested in patients with all forms of brain cancer, both primary and metastatic.

?In this Phase I study, we are examining the safety of multiple doses of dexanabinol, extent of penetration into the brain, and suitability for future trials,? said Santosh Kesari, MD, PhD, principal investigator, and director of neuro-oncology, UC San Diego Moores Cancer Center. ?What we hope to determine is the safe and optimal dose of drug in the brain.?

Dexanabinol is a cannabinoid derivative that causes no psychotropic effects. It was tested previously as a neuroprotective in patients with traumatic brain injury. During these trials the drug was found to cross the blood-brain barrier. More recently, researchers at e-Therapeutics, the trial sponsor, showed that dexanabinol kills cultured cancer cells derived from many tumor types. Additional research in Kesari?s lab demonstrated the drug?s anti-cancer effects in patient-derived brain cancer cell lines.

Dexanabinol?s potential in fighting cancer was identified through a new approach to drug discovery called network pharmacology, a way to analyze the network of proteins underlying a disease process. Network pharmacology enables scientists to seek drugs from among existing compounds, or design new molecules, that act simultaneously on a number of individual proteins to disrupt the cancer-susceptible network.

Kesari added that this trial fits well with a broader national effort to re-purpose existing drugs for the treatment of cancer. He asked, ?Why not use drugs that are currently available and learn how they can be applied in new effective ways for different indications??

Dexanabinol is thought to act on proteins including NF?B, TNF?, COX-2 HAT, FAT and cyclin-dependent kinases. The trial at UCSD Moores Cancer Center is one of two ongoing Phase I studies with dexanabinol, and the first to evaluate the drug in cancer patients.

?In time, we will explore the association between the molecular phenotype of the tumor and the patient?s response, which may allow us to personalize future therapies,? said Kesari, associate professor, Department of Neurosciences at UC San Diego School of Medicine.

Patients who are eligible for this trial must have failed prior therapy including surgical resection, radiation therapy and systemic therapy.

Royal Collection buys Warhol portraits of queen

(AP) ? Britain's Royal Collection Trust is going Pop Art with the purchase of four famous Andy Warhol portraits of Queen Elizabeth II.

The colorful screenprints are based on a formal photograph of the queen wearing a tiara and necklace that was used during her Silver Jubilee celebrations in 1977.

They will form part of the Portraits of a Monarch exhibit starting in November at Windsor Castle.

The purchase brings Warhol's distinctive style to a collection of portraits of British rulers that dates back to the 15th Century.

Officials declined Monday to specify how much was paid for the portraits.

The exhibit will be open to people who visit Windsor Castle, which is roughly 20 miles west of London. It will run until June 2013.

It was life imitating art just off to the side of the red carpet outside the Nokia Theatre entrance as "Mad Men" newbie Ben Feldman caught a smoke.

The resourceful first-time nominee discovered a corner tucked away from the scads of cameras and celebrities that was the perfect spot for a quick pre-show cigarette.

Unfortunately, there weren't any bottles of scotch nearby for him to wash it down with, but just inside the lobby of the Nokia Theatre attendees were lined up at the concession stand for $10 cocktails.

Feldman's "Mad Men" leading man Jon Hamm held court on the other side of the lobby, attracting a line of attendees who wanted a photo with the veteran nominee.

Jimmy Fallon is playing musical chairs at this year's Emmy Awards, in more ways than one.

The 2010 Emmy host, interviewed on the red carpet, noted he has passed hosting duties on to another Jimmy this year, name of Kimmel.

As a result, Fallon said, he doesn't even have a ticket to the 2012 show.

"But Clint Eastwood said he was going to save me a chair," Fallon cracked.

His advice to this year's Jimmy: "Don't make out with Betty White. There's cameras everywhere and you'll get caught. And definitely go to Honey Boo Boo's after-party, cause that's gonna be where it's at."

SEEING STARS ON THE RED CARPET

At the Emmys there's the red carpet and then there's ? well ? the other red carpet.

As the main red carpet fills up, security tries to keep the line moving by directing the big stars down the carpet where cameras are lined up to film them and entertainment journalists are waiting to interview them.

Meantime, the less famous are directed down a parallel red carpet closer to the fan bleachers.

"Please continue walking," security guards continuously say.

Sometimes they'll also give a gentle nudge to someone on the B-list red carpet who lingers too long taking pictures of the folks on the A-List red carpet.

KEEPING COOL IN THE FAN BLEACHERS

Fran and Elmer Armstrong are awards show veterans, joining throngs of fans for at least their sixth Emmy Awards Show on a sweltering Sunday afternoon.

The retired St. Louis couple's quest for a front row seat in the fan bleachers beside the red carpet began when they lined up outside the Nokia Theatre around 7:30 a.m. Sunday. As the day progressed, and temperatures rose, they hung in there, cheering as the cameras from E! Entertainment television filmed pre-show segments.

"Goodbye Giuliana," 70-year-old Elmer Armstrong shouted to anchor Giuliana Rancic as the E Entertainment crew wrapped up.

With temperatures topping 90 degrees, he and his 71-year-old wife were like many in the stands ? trying to keep cool with water and wet paper towels. At least this year's stands are shaded. Elmer Armstrong recalled one year when fans were forced to sit in the blazing sun.

That's not the only change to this year's fan seating ? a tall wall keeps fans from glad-handing or even getting autographs from cooperative celebrities.

Elmer Armstrong remains at the ready, however ? keeping his digital SLR camera and telephoto lens handy to get shots of the stars.

It was the second annual Positively Pink Breast Cancer Walk in Pittsford.

Walkers follow a 1.7 mile course through the town and along the Erie Canal path. Dogs were welcome to tag along.

Monroe County Executive Maggie Brooks cut the ribbon at the start of the walk, while Congresswoman Louise Slaughter presented awards to teams for outstanding fundraising.

Slaughter also helped unveil a new logo for the organization responsible for the walk, Embrace Your Sisters.

Bodies moved from Kenya mass graves, police suspect

MOMBASA (Reuters) - Bodies may have been moved from mass graves in Kenya to prevent an investigation into a suspected slaughter of villagers during inter-tribal unrest in the Tana River region, police said.

The suspected graves were found on Monday in Kilelengwani village, the focus of fighting in the coastal area that has killed more than 100 people in the past three weeks, including nine police officers.

The scale of the unrest has left many Kenyans convinced it was politically instigated and has raised fears of serious tribal fighting before elections due in March.

The Kenya Red Cross said at least 20 people believed to have been killed were still unaccounted for, and they suspected their bodies had been buried in the graves.

Regional police chief Aggrey Adoli said only a human foot and human skin had been found after two hours of digging, however.

"The whole place appeared freshly dug and was exuding the stench of rotten flesh ... we all were surprised when nothing was found. Those who removed the bodies must have been striving to hide some evidence," he said by telephone late on Thursday.

"It is possible that the graves might have been tampered with and bodies removed before police arrived at the scene to seal it off," Adoli said.

Raiders shot, hacked and burnt to death 38 people last week in Kilelengwani and 20 people have been arrested and charged with murder over the killings. Those arrested include members of both rival tribes involved in clashes, the Pokomo and Orma.

Local human rights groups have blamed the violence on incitement by politicians seeking to drive away elements of the local population they believe will vote for their opponents.

President Mwai Kibaki imposed a curfew last week and sent extra security forces to the area to try to end the violence, intensified by an influx of weapons in the last few years.

Settled Pokomo farmers and semi-nomadic Orma tribesmen have clashed for years over access to grazing, farmland and water in the coastal region. Dams along the Tana River, Kenya's longest, supply about two thirds of the east African state's electricity.

NHL cancels September slate of preseason games

NEW YORK (AP) ? The NHL canceled its entire September preseason game schedule on Wednesday, the first on-ice casualty of the four-day lockout.

The league is wiping out all games through Sept. 30, a move it deems "necessary because of the absence of a collective bargaining agreement" with the players' association.

The NHL also said the 2012 Kraft Hockeyville preseason game, scheduled for Oct. 3 in Belleville, Ontario, has been postponed until 2013, bringing the total to 60 games called off on Wednesday.

The regular season is scheduled to begin on Oct. 11.

NHL Deputy Commissioner Bill Daly said the league has "no set policy on cancellations" of other games.

Also Wednesday, a person familiar with the plan says NHL employees at the league offices will switch to a four-day work week Oct. 1 because of the lockout.

The move will effectively cut salaries by 20 percent. The person spoke on condition of anonymity Wednesday because the NHL hadn't made the plan public.

The news was first reported by The Canadian Press.

The Florida Panthers and Ottawa Senators have let staff go because of the lockout, while several other teams have said they don't have any plans to do so as of now.

The league locked out its players at 12:01 a.m. Sunday, its fourth shutdown since 1992.

The preseason cancellations included a Washington Capitals game against the Columbus Blue Jackets on Sept. 26 in Baltimore.

Last year, in the inaugural Baltimore Hockey Classic, the Capitals hosted the Nashville Predators and drew a sold-out crowd.

NEW YORK (AP) - Ryan Howard hit a go-ahead homer with two outs in the ninth inning and the Philadelphia Phillies rallied to beat the New York Mets 3-2 on Wednesday night, adding a dramatic victory to their late-season playoff push.

Jimmy Rollins hit a leadoff home run but the Phillies went into the ninth with only two hits. Chase Utley worked a two-out walk against rookie Josh Edgin (1-2), filling in for ailing Mets closer Frank Francisco, and Howard launched a 93 mph fastball off the facing of the second deck in right field to give his team a 3-2 lead.

The big slugger pumped his fist as he rounded first base and Phillies players broke into a happy frenzy on the bench. It was Howard's 11th homer in an injury-shortened season and first since Aug. 31.

Trying for a last-gasp postseason charge after a miserable first half, the surging Phillies (75-74) won for the 10th time in 13 games. They began the day four games behind St. Louis for the second NL wild-card spot - with three other teams in between.

Cole Hamels equaled a season high with 10 strikeouts over six innings and left trailing 2-1. Philadelphia's young bullpen kept it close, and Jeremy Horst (2-0) got Andres Torres to ground into an inning-ending double play with the bases loaded in the eighth.

Jonathan Papelbon worked a one-hit ninth for his 36th save in 40 tries.

The punchless Mets wasted a splendid outing from Matt Harvey, who finished his rookie season with a flourish. David Wright hit a solo homer but the Mets (66-82) dropped their eighth straight home game and 24th in the last 28 at Citi Field.

This one guaranteed them a fourth consecutive losing season, despite a 46-40 first half.

New York has lost four in a row and 10 of 11 overall. The Mets have managed three runs or fewer in a team-record 15 straight home games since a 6-5 win over Atlanta on Aug. 12 at Citi Field.

The previous major league club to score three runs or fewer in more consecutive home games was Seattle, which went 16 in a row in 2010.

Harvey struck out seven and did not allow a hit after Rollins' home run in the latest eye-catching performance of his promising season. This one was the last, too. The prized right-hander, drafted seventh overall in 2010, will be shut down after 10 major league starts to protect his 24-year-old arm.

A bright spot in an otherwise dismal second half for New York, Harvey walked three and threw a career-high 112 pitches over seven stellar innings. He has thrown 169 1-3 innings this season between the Mets and Triple-A Buffalo.

Harvey got two double plays and whiffed Howard for the second time with a 97 mph fastball in the seventh. He walked off to a standing ovation from the sparse crowd 21,741 and received a handshake from veteran catcher Kelly Shoppach.

Bobby Parnell struck out two in a one-hit eighth, handing the lead to Edgin, who was trying for his first career save. Francisco was unavailable after an MRI showed tendinitis in his pitching elbow.

One night after the teams were rained out at Citi Field, Rollins gave the Phillies another quick start when he homered to right on Harvey's fifth pitch. It was his 43rd career leadoff shot and sixth this season.

Rollins, who homered and scored twice in Monday night's 3-1 victory over the Mets, has 22 home runs this season and seven this month - five in the last eight games.

Ruben Tejada singled and stole second with two outs in the third before scoring on Daniel Murphy's tying single.

Wright opened the sixth with an opposite-field drive to right-center for his 201st career homer and 18th this year. After a sensational start to the season, he has only two home runs and 12 RBIs since July 28.

The next batter was Scott Hairston and he was hit in the back by Hamels' second pitch.

ASUS Transformer Pad TF300T updated with minor stability fixes

ASUS Transformer Pad TF300T owners are reporting that they're receiving another over-the-air update today, designed to improve stability of the Tegra 3-based tablet. Since the TF300T has already received its update to Jelly Bean, there are no significant changes to the underlying Android framework. But hopefully this latest OTA will fix some of the performance and usability issues that have been reported by some TF300T owners. The update brings the tablet up to version 10.4.2.13, still based upon the latest Android 4.1.1 Jelly Bean.

If you've got a Transformer Pad TF300T, head to Settings > About tablet > Software updates to see if the new version is ready to download onto your tablet. Once you're installed, hit the comments and let us know how you're getting on.

Late-night comedy television increases political discussion

Official White House Photo by Pete SouzaANN ARBOR, Mich.?The jokes by late-night comedy television hosts can be just as effective as regular political news in spurring discussion among viewers, a new University of Michigan study shows.

In addition, political candidates could help their campaigns with mentions by shows like "The Daily Show with Jon Stewart," "Late Show with David Letterman" or "The Tonight Show with Jay Leno."

"The constructive role of comedy shows evidenced in this study suggests that political entertainment may serve as an important catalyst for revitalized civic life," said Hoon Lee, who conducted the research while seeking his doctorate from the U-M Department of Communication Studies. "This is an important finding, because then political candidates may be willing to use comedy programs to enhance their images."

About 770 people completed an online experiment and a mail survey. The gender breakdown was nearly equal (51 percent female), most were white (74 percent) and the party affiliation was 36 percent Democrat and 34 percent Republican. They were assigned to one of three groups: late-night comedy, television hard news, or control.

The first group of 256 people viewed a short video clip from "The Daily Show" comprising several segments about the government's bailout of big companies. The second group of 254 people was exposed to an "NBC Nightly News" video clip that also featured selected coverage of the government's bailout of big companies. The late-night comedy clip was humorous and sarcastic as Stewart would typically entertain and provoke audiences, whereas the hard news clip remained serious in tone.

The third group, which consisted of 258 people, viewed a clip about a Disney Resort in Orlando. This served as a control providing a baseline comparison for the effects of late-night comedy viewing.

Once participants finished viewing the video clips, they all completed the questionnaire measuring their emotions, attitudes and intentions regarding the economy. Behavioral intentions could include attending a political meeting, rally or speech; contacting a public official or a political party; and displaying a bumper sticker or yard sign on a political issue.

Lee said the findings imply that exposure to late-night comedy limits with whom individuals were willing to discuss politics. In other words, people typically talk about the shows with others who share their beliefs and interests. As a result, the humor-induced discussions may spur political participation.

The research also indicates that while both late-night comedy television and hard news engages audiences, late-night audiences are more likely to use online interaction as a way to comment on political issues.

"The current research suggests that political comedy can play a significant role in the public realm," said Lee, a fellow at the Nam Center for Korean Studies at the U-M International Institute. "Indeed, the results indicate that exposure to late-night satire can enrich deliberative and participatory democracy."

The findings appear in the current issue of Mass Communication and Society.
